The insurance companies have substantial legal departments, many of them employing staffs of lawyers that are employees on a fulltime basis. Their primary job is to limit as much as possible the amount recovered by people who are injured or damaged through negligence.

It is by doing so that they are able to obtain a settlement which allows them to pay damages to injured parties in an amount substantially less than the value of their claims. Generally speaking, individuals have no idea what their claim may be worth in terms of economic and noneconomic damages.

As a rule, personal injury lawyers will take a case on contingency, which means that there is no attorney fee unless there is a recovery and the fee in that case is dependent upon a percentage agreed upon between the attorney and client.
